Sažetak
Pravna su pitanja svojstvena prekograničnom pravnom prometu vezana uz zaštitu dobrobiti životinja, javnog zdravlja te sprečavanja širenja bolesti uslijed prijelaza granice. Nadalje je vrlo značajno pitanje otkrivanja i suzbijanja nezakonite trgovine ljubimcima, koja je među najvećim izazovima suvremene regulacije. U konačnici i zakonita trgovina, prodaja i pružanje prekograničnih usluga (pa i veterinarskih) u vezi kućnih ljubimaca može predstavljati pravni izazov, ukoliko dođe do povrede ugovornih obveza. Valja imati na umu da se regulativu u vezi životinja stricto sensu primjenjuje uz pravila drugih pravnih grana, kako bi se odgovorilo na pravna pitanja u vezi kaznene i građanske odgovornosti, upravnog postupanja pa i prekograničnog prometa istima.

COMPANION ANIMALS (PETS) WELFARE – CROATIAN LAW IN THE LIGHT OF EUROPEAN AND INTERNATIONAL RULES AND STANDARDS

T he growing interest in pets is accompanied by an increase in the “pet market” and the market for ancillary goods and services. At a time of ubiquitous globalization and soft borders, particularly within the European Union, the rate of cross-border trade in pet is expectedly increasing. At the same time, anthrozoology indicates significant changes in the human perception of animals as well as the relationship between humans and them. These trends raise the issue if existing legal regulation is appropriate. Regional, international and intergovernmental organizations have been engaged in promoting and ensuring raising of animal welfare standards. It resulted with many changes to national and uniform regulations over the last decade. In terms of animal welfare protection Croatian legislation is strongly influenced by the regulatory framework which has been developed by the EU over the last decades. The introduction of the concept of an animal as a “sentient being” in the Treaty on the Functioning of the European Union not only set a new minimum standard for the drafting of regulations within EU competence, but also to the practical application and interpretation of pertaining rules before the competent authorities of the Member States, including Croatia. Still, Art. 13. The TFEU imposes an obligation to respect the principles of animal welfare when adopting rules in policies for which Member States have conferred certain powers on it. This is why these regulations are in agricultural (farm animals), transport or, for example, EU common market (laboratory animals) policies.
This explains why, with the exception of several directives, we currently cannot find European rules pertaining per se to pets or stay animals. A series of pet-oriented action policies suggest that this may change in the future. The implementation of European policies should take into account the commitments made by the State. In doing so, it is necessary to distinguish which measures are necessary and which remain within margin of discretion or are fully governed by domestic legislature. In order to ensure the well-being of pets moving across borders, it is particularly important to introduce well-thought-out solutions and practices on a database for pet records, the interpretation of the concepts of commercial versus non-commercial movement, as well as breeding, husbandry and care policies, as well as advertising policies for pet and related services in the digitalized world.Legal issues inherent in cross-border legal trade relate to the protection of animal welfare, public health and the prevention of the spread of diseases due to border crossing. Furthermore, a very important issue is the detection and suppression of illegal pet trade, which is one of the major challenges of modern Regulation. Finally, legitimate trade, sale of pets and pet supply and cross-border services (including veterinary) in relation to pets can be a legal challenge if contractual obligations are breached. It should be borne in mind that stricto sensu animal related legislation applies in addition to the rules of other branches of law, in order to answer legal questions relating to criminal and civil liability, administrative procedures as well as cross-border movement.
